What is Personal Information?

For the purposes of this Privacy Policy, the term "Personal Information" means any information about an identifiable individual, such as name, birth date, address and other information pertaining to such individual's identity. The types of Personal Information we collect about you will depend on your interactions with us and are described in more detail below.

What Personal Information We Collect

We collect Personal Information directly from you when you interact with us or use our products or services. The types of Personal Information we collect depends on how you interact with us and/or which products and services you use. We may collect the following categories of Personal Information directly from you: 

  • Identifying Data. We collect certain data that you provide to us when registering or creating an account. Examples of such data include your name, email address, and your organization’s name, which are used to allow you to log into and use our products. 

We automatically collect certain Personal Information when you interact with us or use our products or services. The types of information we collect automatically when you use our products or services may include: 

  • Device and Network Data. Depending on which Company product or service you use, we may collect certain information about the device you use to access our Services. Examples of such data include: 
    • IP address. For security and monitoring of system health.
    • Browser agent. Browser agent strings provided by modern browsers for use in analytics reports provided to our customers.
    • Page views and user interactions. For the purpose of providing customer support and improving our products.
    • Session ID. Randomly generated GUID used to provide analytics reports associated with sessions to our customers.
    • Device ID. Randomly generated GUID used to provide analytics reports associated with the number of devices to our customers.
    • User ID. Randomly generated GUID used to provide analytics reports and to improve the product
    • API Key ID. Used to track usage and managing permissions
    • Search queries. Anonymized data used to provide analytics reports to our customers.
    • Device position. Anonymized position of the device in order to display a blue dot in “wayfinding mode”, and to provide anonymized aggregate reports to our customers.
    • Screen Capture. Period screen capture used for the monitoring of directory health.
    • API/feature usage. Anonymized data for the purpose of improving our products.

In addition to Personal information, we may automatically collect information when you visit our website. This may include the browser you used to come to our website, the Uniform Resource Locator ("URL") of the website that you just visited before visiting our website, your access times, language, your usage and activity on our website, your location, any search terms you entered, and which URL you go to next. We may use third-party analytics, cookies and other online tracking technologies to help us collect information of Users who visit our website.

Purposes for the Use of Personal Information

We collect and use personal information for the following purposes: 

  • Provide our products and services. Provide, administer, deliver, customize, maintain and improve our data, products and services. 
  • Respond to you. Respond to your request when you contact us, including to provide customer service and answer questions about our products. 
  • Manage Accounts. Create and manage your online accounts, profiles, and managing permissions
  • Advertising and Marketing. Send newsletters, advertising or marketing communications about our products, and provide information that we believe may be of interest to you, as permitted by applicable law.
  • Research and Development. Conduct research and development.
  • Safety and Security. Detect and protect against malicious, deceptive, or illegal activity, including errors, security incidents, and other potential harm to us or our users.
  • Comply with Legal Obligations. Comply with our legal or regulatory obligations, including our tax obligations and those related to the prevention of fraud and money laundering, and those required for you to benefit from rights recognized by law, or any regulatory requirements or provisions; and
  • Reasonable Other Purposes. Other than as permitted or required by applicable laws, if we wish to collect, use or disclose your Personal Information for purposes that are not contemplated in this Privacy Policy, we will identify those purposes at the time of collection. You will be given a reasonable opportunity to opt-out of any such additional purposes.

There is no contractual or statutory obligation for you to provide Personal Information. If you do not provide Personal Information, we will not be able to provide certain products and services to you.

Legal Basis for Processing

If you are an EU resident, we process your Personal Information only when we have valid legal grounds, such as when:

  • You consent to processing of your Personal Information, such as when we process special categories of Personal Information. When you consent, you can change your mind at any time.
  • The processing is necessary for us to provide you with the products and services you request, such as when you register for an account or interact with our services, or to respond to your inquiries.
  • We have a legal obligation to process your Personal Information, such as to comply with applicable tax and other government regulations or to comply with a court order or binding law enforcement request.
  • To protect your vital interests, or those of others, such as protecting the safety of users.
  • We have a legitimate interest in carrying out the processing activity. For example:
    • To analyze and improve the safety and security of the services. This includes implementing and enhancing security measures and protections and protecting against fraud, spam, and abuse, or
    • To maintain and improve the products and services.

Disclosure of Personal Information 

The Company may share your Personal Information with third parties for the purposes described below:

  • With our third party service providers in order to fulfill your order of our product and services or to perform specific services on our behalf (such as credit card processing, credit card information updates, prize fulfillment of our contests, collection of overdue accounts, management of customer service requests, and product delivery);
  • With parties connected with the contemplated or actual financing, insuring, sale, assignment or other disposal of all or part of our business or assets, including for the purposes of determining whether to proceed or continue with such transaction or business relationship or fulfilling any records or other reporting requirements to such parties;
  • With our legal advisors or appropriate governmental authorities, if you have violated our terms of service or conditions of purchase, or if we need to comply with applicable laws and lawful governmental requests, and for legal reasons; and
  • With other Mappedin users that are associated with the same customer or subscriber account. 

Your Personal Information may be processed and stored outside of the province in which you reside and/or outside of Canada by us, an affiliate or a third party service provider for the purposes set out in this Privacy Policy. Some jurisdictions may not provide levels of data protection that are equivalent to those of your home jurisdiction. In certain circumstances, foreign courts, law enforcement agencies or regulatory agencies may be entitled to access your Personal Information.

If you are a Quebec resident, your personal information may be transferred or disclosed to service providers located outside of Quebec. 

If you are an EU resident, your personal information may be transferred or disclosed to service providers located outside the EU, consistent with applicable law. As such, we (i) rely on adequacy decisions of the European Commission or (ii) enter into the European Commission’s Standard Contractual Clauses as issued on 4 June 2021.

The Company has and does its best efforts to maintain technical, contractual, administrative and physical security measures to protect your Personal Information in a manner that is reasonable and appropriate to the nature of the Personal Information you provide to us.

Cookies and Analytics 

If you use our website, we may assign an internet cookie. An internet cookie is a small text file that a website stores on your internet browser and that can collect and store information. We use cookies to better understand how you use our website, to make sure our ads and dynamic content are served correctly and to improve the performance of our website. For example, a cookie may recall a set of preferences you have set for our website and record items that you have registered. Retention of your Personal Information

We keep your Personal Information for such period as is reasonably necessary to meet the purposes for which it was collected or to comply with any legal requirements, including statutory retention periods. When your Personal Information is no longer required for a specific purpose or legal requirement, it will be securely erased from our records or made anonymous.

Children’s Privacy

The Company’s products and services are not intended for children under the age of 18. We do not target our products and services to children under 18.

Your Choices

Depending on where you reside, you have the right to (1) request to know more about the categories and specific pieces of Personal Information we collect, use, share, and disclose, (2) withdraw consent you may have previously given;  (3) request deletion of your Personal Information, (4) opt out of any sharing of your Personal Information that may be occurring, (5) request access to your Personal Information; (6) request correction of inaccurate Personal Information, and (7) not be discriminated against for exercising these rights.

Please note these rights are subject to legal exceptions and in exceptional circumstances only, we may charge for this service. We will respond to reasonable requests as soon as practicable, and in any event, within the time limits prescribed by law.
